ORDINANCE ON PASSENGER TRANSPORT AND TERMS OF TRAVEL IN SOFIA’S PUBLIC TRANSPORT

I.GENERAL PROVISIONS

Art. 1 This ordinance regulates the prices for and conditions under which mass transit operators (MTO) transport passengers by tram, trolleybus, bus and underground train in the Municipality of Sofia.

Art. 2 This common ordinance shall be applied by all MTO’s in the Municipality of Sofia that operate the main services of the Municipal Transport Scheme.

Art. 3 The ordinance regulates the procedure and conditions of travel on mass transit vehicles with the vehicles of Mass Public Transport (MPT), as well as the way of compensation of transport documents for concession travel.
Art. 4 By virtue of a contract with the Municipality of Sofia, Urban Mobility Centre EOOD shall collect revenue from, organize, manage and monitor passenger transportation via mass transit and report on and assess the quality thereof as an integrated transportation process, the performance of which is granted by the Municipality of Sofia to the transport operators. The Municipality of Sofia shall pay the transport operators for their efforts in line with the economic framework.

II.TRANSPORT DOCUMENTS. CONDITIONS OF TRAVEL

 

5 (1) Passengers (except children under 7 years of age) shall be transported on Sofia Public Transport only if they are in possession of a valid ticket, pass or other transport document that conforms to the approved sample shown in Appendix 1.

(2) A standard transport document is a form of contract for a journey, made between the transport operator and the passenger.

Art. 6 (1) The ticket is a transport document and according to the approved samples in Appendix No 1 may be:single journey ticket

- single journey ticket sold by the driver

-single journey ticket issued by the ticket machine in trams and trolleybuses

- (new by Resolution No 433 as per Minutes No 43 from 25.06.2009) a single journey ticket, issued by ticket machines at the entrance of the underground or by a cashier in an underground ticket desk of Metropoliten EAD;

- two-stage journey ticket (bus/tram/trolleybus and underground) – valid for 60 minutes;

- five- or ten-voucher ticket for single journeys by one passenger (each voucher is valid only as part of a 5- or 10-voucher ticket);

- e-ticket for 5 or 10 single journeys by one passenger, credited to a travel smartcard (TSC) – in trolleybuses or trams;

- (new by Resolution No 433 as per Minutes No 43 from 25.06.2009) e-ticket for 5 or 10 single journeys credited to a travel smartcard (TSC) - for the underground

- penalty fare ticket for a passenger without a valid ticket;

- (amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) tram and trolleybus ticket for passenger who has not validated his/her travel smartcard.

(2) The ticket becomes a valid transport document only after:

- it has been punched in the closest punching machine immediately after boarding;

- it has been punched and the boarding time has been marked in the case of a 2-stage journey ticket (bus/tram/trolley and underground train) that is valid for 60 minutes;

- it has been issued from an on-board ticket vending machine in trams and trolleybuses. No additional validation is necessary.

- (new by Resolution No 433 as per Minutes No 43 from 25.06.2009) it has been issued by a ticket vending machine at the entry of the underground or by a cashier at a ticket desk of Metropoliten EAD. It must be validated by the validator machines, situated at the barrier at the entrance of the underground.This ticket may be used to board the underground for up to 30 minutes after being issued.

- (amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) validation of a TSM (issued and credited by Urban Mobility Centre EOOD) performed immediately after boarding, at the validators located near the doors of trolleybuses and trams.

- (New by Resolution No 433 as per Minutes No 43 from 25.06.2009) validation of a TSM (issued and credited by Metropoliten EAD) performed at the validators at the entry of the underground.

(3) A penalty fare ticket for a passenger without a valid ticket shall be issued and validated by conductors of Urban Mobility Centre EOOD.

(4) (amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) a tram or trolleybus ticket for a passenger, who has not validated his/her travel smartcard, shall be issued and validated by conductors of Urban Mobility Centre EOOD.

Art 7(1) The travel card is a transport document with a validity period specified according to the approved samples under Appendix No 1. Types of travel cards:

- Anonymous travel cards: in paper or electronic format (smartcard)

- (New by Resolution No 433 as per Minutes No 43 from 25.06.2009) Personal travel cards for concession travel: in paper or electronic format (smartcard)

(2) The travel card is a valid transport document only if it is effective and used for travel on the specified service.

(3) The travel smartcard is a valid transport document only if it is: effective, used for travel on the specified service and it is validated in the vehicle.

(4) (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009). The travel smartcard must be validated at the validators in trams and trolleybuses or situated at the gates of underground stations. The validators validate only effective smartcards used on the correct service.

Art. 8 (1) Paper transport documents are documents with security features, printed according to the regulations of the Ordinance on Procedures and Conditions of Printing and Monitoring of Securities.

(2) A travel card issued for a specific service is usable on all vehicles whose routes and stops overlap (including stops within one crossroads) with the route and stops of the service(s) specified on the card, though only within the overlapping sections. The travel card is also usable on substitute services introduced during temporary diversions of traffic.

(3) Prices of tickets and travel cards for transport of passengers are stipulated in Appendix No 2.

Art. 9 (1) A passenger who holds a valid transport document has the right to free transit of hand luggage of dimensions of up to 60x40x40 cm. The measurement is taken using a measuring tool. The charge for each piece of luggage of dimensions exceeding those specified above is:

- one single trip ticket (bought in advance from the driver or from on-board ticket vending machine in trams and trolleybuses)

- one voucher from a 5- and 10-trip ticket (only if the passenger is travelling with a voucher from the same ticket).

(2) A passenger who holds a valid transport document has the right to free transit of a pushchair.

Art 10. Transport documents issued for travel on public transport vehicles in other populated areas on the territory of the Republic of Bulgaria are not valid on mass transit on the territory of the Municipality of Sofia, except the transport documents pursuant to art. 20.

Art. 11 Persons, who are entitled to travel on concession fares on the regular lines of the MPT and the conditions under which they can use this right, are stipulated in section IV.

Art. 12 When on public transport passengers must:

1. Have a valid transport document and keep it until getting off the vehicle;

2. Present their transport document for inspection to the competent inspection officials. Passengers who travel with a pass must also show a passport or an ID card;

3. Board the vehicle from the first door when buying a single-journey ticket from the driver or from the on-board ticket vending machine;

4. Get on and off the vehicles only when they come to a complete standstill at the designated stops;

5. (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) present a passport or an ID card to the ticket inspector after being found in violation and refusing to pay the penalty fare for a passenger without a valid transport document or a ticket for a passenger with a non-validated smartcard in trams and trolleybuses.

Art. 13 The following persons and items are not allowed on the public transport vehicles:

1. People who pose a risk to the passengers’ safety or act disorderly in the vehicles;

2. People under the influence of alcohol or drugs;

3. People with unkempt appearance and/or carriers of an infectious disease;

4. Items that may damage or contaminate the vehicles;

5. Inflammable, explosive, poisonous substances as well as other items that may be dangerous for the passengers and the staff;

6. Items whose transportation is prohibited by law;

7. Items which, due to their size and features, inconvenience the passengers;

8. Live animals and birds. An exception is made for police dogs and guide dogs for blind people; the dogs must have a muzzle, a short lead and a “red cross” sign.

Art. 14 Public transport passengers are prohibited from:

1. Staying on the doorsteps of the vehicles and impeding the closing of their doors;

2. Speaking with the driver or otherwise diverting his attention when the vehicle is in motion;

3. Causing disorder or disturbing other passengers;

4. Making the vehicles and the validating devices dirty and/or damaging them;

5. Endangering though their actions the traffic safety and the other passengers’ security;

6. Doing any business, advertisement or religious activity;

7. Smoking and/or having foods and drinks in vehicles and in underground stations;

8. Giving their transport document to other people;

III. ISSUING AND TOPPING UP THE TRANSPORT DOKUMENTS

Art. 15 (1) Urban Mobility Centre EOOD has the exclusive rights to issue, top up and sell transport documents for travel on the mass public transport in the Municipality of Sofia through:

- Travel card and ticket outlets

- Ticket desks

- Ticket vending machines in trams and trolleybuses

- Retail dealers under commission contracts-

- Drivers of public transport vehicles who must have single-journey tickets on hand.

Art. 16 (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) Metropoliten EAD shall issue, credit and sell the following transport documents for travel by the underground:

- Single-journey underground tickets;

- E-tickets for 5 or 10 single underground journeys.

Art. 17 (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009)

(1) Anonymous travel smartcards (TSC) shall be issued after filling in an Application Form for Issuance of Travel Smartcard for Public Transport in Sofia and shall be topped up in the travel card outlets of the Urban Mobility Centre EOOD.

(2) An anonymous travel smartcard may be issued to a person without an application for issuance of a travel smartcard for public transport in Sofia by request of such person. A card issued in this way shall not be blocked and duplicate shall not be issued.

(3) Anonymous travel smartcards are credited at a standard fare selected by the citizen as per Appendix 2.

(4) Anonymous travel smartcards may be topped up multiple times at various standard fares selected by the citizen.

Art. 18 (1) After a person completes an application form, their details must be entered into the travel smartcards (TSC) for concession travel upon issuance.

- Internal identification - personal details of the holder (full name, Personal No., permanent address of residence) and the type of concession are stored on the card’s memory.

- (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) External identification - card registration number, current photo, full name and type of concession must be printed on the surface of the card. When issuing smartcards to disabled people who are entitled to use an assistant, the names of two assistants, specified by the holder of the card, must be printed on the card’s surface.

(2) A card shall be credited at the appropriate concession fare selected by the citizen, as stipulated in Appendix 2.

(3) The card may be credited multiple times at different fares depending on the concession.

IV. CATEGORIES OF TRAVELERS ENTITLED TO CONCESSIONS. CONDITIONS AND TYPES OF CONCESSIONS

Art. 19 The following persons have the right to travel with a standard public servant card:

1.Members of Parliament;

2.Control Authorities according to the Road Traffic Act.

Art. 20. The following persons are entitled to travel with personalized cards that conform to the standard format used nationwide and have been approved by the Ministry of Transport:

1. War veterans;

2. (Amended by Resolution No 176 as per Minutes No 36 form 26.03.2009) Disabled veterans and war victims pursuant to Art. 17 of the Disabled Veterans and War Victims Act;

3. State officials from the Ministry of Internal Affairs;

4. State officials from the specialized security department and the Head Department of Corrections at the Ministry of Justice and Special Courier Service for the Minister of State Administration and Administrative Reform

5. State officials from the National Security Agency.  

Art. 21 (1) The following persons are entitled to travel with a personalized concession card that conforms to the format approved by the Municipality of Sofia:

1. (Amended by Resolution No 767 as per Minutes No 54 from 17.12.2009) People with disabilities of a general nature who receive pension until reaching 68 years of age, as well as their assistant, if they are entitled to one, and who are registered as residents in the Municipality of Sofia.

2.(Amended by Resolution No 767 as per Minutes No 54 from 17.12.2009) Children with severe physical and/or mental disabilities, whose reduced adaptive capabilities are rated at 50 percent or less, as well as their assistant, if they are entitled to one, and who are registered as residents in the Municipality of Sofia.

3.(Amended by Resolution No 767 as per Minutes No 54 from 17.12.2009) Blind citizens, as well as their assistants, if they have the right to one, who are registered as residents in the Municipality of Sofia.

4.(Amended by Resolution No 767 as per Minutes No 54 from 17.12.2009) All disabled people diagnosed as DEAF who are registered as residents in the Municipality of Sofia.

5.People who receive pension under the conditions of Section VI of the Social Security Code, who have reached the age stipulated under Art. 68, Par. 1-3 of the same code, and who are registered as residents in the Municipality of Sofia.

6.Elderly citizens over 68 years of age who are registered as residents in the Municipality of Sofia.

7.Rescuers from the Mountain Control and Rescue Service – up to 120 people.

8.All full-time students at colleges and universities, whose campuses are located on the territory of the Municipality of Sofia, including graduating students who are working on their diploma before the first diploma session;

9.All school-goers in the municipality of Sofia up to and of 20 years of age who have enrolled at schools on the territory of the Municipality of Sofia that are in the list of the Ministry of Education and Science;

10.Members of the family of those who work in the system of the public transport – spouses;

11.All students from homes for children without parental care based on the territory of the Municipality of Sofia;

12.Full-time PhD students from all universities, whose campuses are located on the territory of the Municipality of Sofia;

(2) Disabled people, whose fitness for work has been reduced by more than 90%, and who are entitled to use an assistant, continue to have the right to travel after reaching 68 years of age.

(3) Permanently disabled people who have been found unfit for work after reaching the age for receiving pension on grounds of making sufficient social security contributions and being of old age or who have reached the age during the deliberation period of TELK (NELK) (Labour/National Expert Doctors’ Committee), may use the rights pursuant to this Ordinance for life regardless of the period stipulated in the experts’ decision.

(4) (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) The assistant can travel with the transport document of the holder pursuant to Par. 1, Item 1, 2 and 3 when accompanying the holder. By way of an exception, only one of the assistants, whose names are printed on the surface of the smartcard, may travel with the transport document without the holder being present.

(5) The assistant must be of legal age and be registered as resident in the territory of the Municipality of Sofia.

(6) The rights pursuant to Art. 20, Item 2 and Art. 21, Par. 1, Item 1, 2, 3 and 4 are given to permanently incapacitated people who are receiving the monetary benefit for transport services as per Art. 25, Par. 2 of the Rules and Regulations on Enforcement of the Integration of Disabled Persons Act

(7) Persons who have performed 13 or 15 years of service in the system of public transport in the Municipality of Sofia doing work under Labour Category II or III respectively before retiring. (Appendix No 3).

Art. 21a (New by Resolution No 433 as per Minutes No 43 from 25.06.2009) The following persons are entitled to travel with concession travel cards - both the paper and electronic variety: employees who work under employment or civil service agreement in Sofia or the regional municipal administration offices – in Activity 122 – Municipal Administration and other full-time positions: Activity 619 – Other Activities in Residential Construction, Public Works and Regional Development (administration), Activity 898 – Other Economy Activities (administration), Activity 389 – Other Educational Activities, Centre for Video Surveillance of Municipal Schools, Kindergartens and Social Institutions for Children (administration), Activity 759 – Other Cultural Activities (with the exception of cultural institutions and houses) (administration), Activity 601 – Management, Control and Regulation of Residential Construction and Land Development Activities (administration), Activity 714 – Sport Facilities for All (administration), Activity 239 – Other Internal Security Activity (administration), Activity 559 – Other Services and Social Insurance, Support and Employment Activities (administration), Activity 525 – Clubs for Pensioners and Disabled People and Other Social Activities (administration) and Activity 469 – Other Healthcare Activities (administration), as well as employees employed pursuant to the Council of Ministers’ Letter No. 66 from 28 March 1996 for recruitment of staff for performance of some of the duties in the budgetary organizations for the abovementioned activities.

Art. 22 The right to concession travel, the period of validity and the personal data of the holder shall be stored on the travel smartcard memory.

Art. 23 Both electronic and paper versions of concession cards shall be issued/credited by Urban Mobility Centre EOOD as follows:

1. Pursuant to Art. 20, Items 1 and 2

a) Pursuant to Item 1 – all year round for the calendar year upon submission of a certificate issued by Chief Administration of the Archives at the Council of Ministers and a personal passport or identity card that states the person is registered as resident on the territory of the Municipality of Sofia.

b) (Amended by Resolution No 675 as per Minutes 24 from 13.11.2008; amended by Resolution No 176 as per Minutes No 36 from 26.03.2009) Item 2 - by presenting a disabled veteran card or a war victim card issued by the Ministry of Defence and a personal passport or identity card that states the person is registered as resident on the territory of the Municipality of Sofia.

c) (New by Resolution No 176 as per Minutes No 36 from 26.03.2009) during the procedure on issuance of cards by the Ministry of Defence to disabled veterans and war victims, transport documents for free travel of the persons stipulated under Art. 20, Item 2 shall be given upon presentation of the following documents:

- For disabled veterans – a copy of the expert decision of TELK (NELK) that has found a link between the work conditions and the disease or the disability of the military personnel and military disability pursuant to the interpretation of Art. 85 of the Social Insurance Code or a copy of the National Insurance Institute’s statement certifying the right to receive pension as a disabled veteran.

- For war victims – a copy of death certificate, certificate of inheritance, National Insurance Institute’s statement, certifying the right of the heir to receive a pension and a certificate of the circumstances of the military employee’s death.

2. Pursuant to Art. 20, Items 3,4, and 5:

For the whole calendar year by request of the Ministry of Internal Affairs, National Security Agency, Ministry of Justice and Ministry of State Administration and Administrative Reform.

3.Pursuant to Art. 21, Par.1, Item 1,2,3,4:

According to lists approved by the Social Activities Department at the Municipality of Sofia.

4. Pursuant to Art. 21, Par 1

a). Pursuant to Item 5 – after presenting a personal passport or identity card or a certificate of eligibility for pension (original or a notarized copy) ;

b). Pursuant to Item 6 - after presenting a personal passport or identity card;

c). Pursuant to Item 7 – for the calendar year, according to a list certified by the head of Mountain Control and Rescue Service;

d). Pursuant to Item 8 – after presenting an identity card and a school report book that shows enrolment in the current academic year;

e). (Amended by Resolution No 767 as per Minutes No 54 from 17.12.2009) Pursuant to Item 9 - after presenting an identity card and school report book or student ID card that shows enrolment in the current academic year;

f). Pursuant to Item 11 – According to lists of the homes for children without parental care, approved by the principals;

g). (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) Pursuant to Item 12 – according to a list of PhD students, certified by the relevant university administration.

5. Pursuant to Art 21a (New by Resolution No 433 as per Minutes No 43 from 25.06.2009)

- according to lists approved by the mayor of Sofia Municipality and the relevant regional mayors and a personal identity card;

Art. 24 Persons who meet more than one of the eligibility requirements for concession travel shall use only one type of transport document of their choice.

Art. 25 All documents, based on which both electronic and paper cards are issued, shall be kept at the relevant departments for a period stipulated in the effective legislation.

V. PROCEDURE AND METHOD OF COMPENSATION FOR CONCESSION TRAVEL

Art. 26 Compensation for concession travel pursuant to Art 19 and Art. 20 shall be received monthly from the state budget through the Municipality of Sofia according to the standard fare for citizens for 1 month on all lines, based on a statement of issued transport documents submitted by Urban Mobility Centre EOOD.

Art.27 (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) The compensation for concession travel under Art. 21, Par. 1, Item 1, Items 2, 3, 4 and 7 and Art. 21 shall be received monthly from the state budget through the Municipality of Sofia according to the cost of the monthly anonymous travel card, based on a statement of issued transport documents submitted by Urban Mobility Centre EOOD.

Art. 28 Compensation for concession travel under Art. 21, Par. 1, Item 5,6,8,9,11,12 shall be received monthly from the state budget through the Municipality of Sofia according to the cost of the monthly anonymous travel card, based on a statement of issued transport documents submitted by Urban Mobility Centre EOOD.

Art. 29 Compensation for concession travel under Art. 21, Par. 1, Item 10 shall be received from the relevant companies according to the cost of the monthly anonymous travel card, based on a statement of issued transport documents submitted by Urban Mobility Centre EOOD.

Art. 30 Compensation for concession travel under Art. 21, Par. 7 shall be paid as a lump sum in the relevant year by the company the person retired from.

Art. 31 Issuance of concession transport documents during the year shall be performed until the allocated amount stipulated in the budget of the Municipality of Sofia for the relevant year is expended. After the amount stipulated in the budget of the Municipality of Sofia for the relevant year is expended, the mayor of the Municipality of Sofia shall issue an order to the Urban Mobility Centre EOOD to temporally suspend the issuance of concession transport documents.

The issuance of concession transport documents shall resume after the approval of a resolution of the Sofia Municipality Council whereby the Sofia Municipality budget is amended for the relevant year or permission is given to use the budgetary surplus or other reserves for the issuance of concession transport documents.

Art. 32 The transportation contractor may not be ordered to perform transportation free of charge or at a reduced rate without stipulations for compensations therefor.

 

VI. INVALID TRANSPORT DOCUMENTS

Art. 33 (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2010)

Transport documents which are not appropriate for the trip (service number or validity period), concession travel cards in the name of a different person, tickets with different details, vouchers from a 5- or 10-trip ticket without the last voucher of this ticket, non- validated smartcards that have been credited with trolleybus or tram e-tickets for 5 or 10 single journeys of one passenger, lack of accompanying documents or the submission of a document not specified in this Ordinance shall be considered as invalid and their owner shall be subject to fines in line with Section VII of the Ordinance.

Art .34 Details on a paper transport document may not be amended, crossed out, highlighted or erased. Otherwise the document shall be declared invalid, its holder shall be fined in line with Section VII of the Ordinance and may be held criminally responsible pursuant to the provisions of the Criminal Procedure Code.

VII. INSPECTION AND FINES

Art. 35 (1) Sofia Municipality Council shall designate the Manager of Urban Mobility Centre EOOD and the Executive Director of Metropoliten EAD with the power to appoint officials from both companies who will perform inspection of the passengers’ transport documents in MPT. The officials (conductors) shall identify themselves using ID’s in a standard format, approved by the Manager of Urban Mobility Centre EOOD and the Executive Director of Metropoliten EAD.

(2) If the ticket inspectors find that a passenger is travelling without a valid transport document, the passenger has to purchase a penalty fare ticket at a price ten times higher than the value of a single trip ticket. The ticket shall be punched by the ticket inspector. This entitles the passenger to continue his/her travel in the same vehicle.

(3) (Amended by Resolution No 433 as per Minutes 43 from 25.06.2009) If the ticket inspectors find that a passenger is travelling with a non-validated travel smartcard in trams and trolleybuses, the passenger has to purchase a ticket for a passenger with a non-validated smartcard at a price equal to the price of a single trip ticket.

(4) If found in possession of an invalid transport document, as stipulated in Art. 33, the passenger has to purchase a penalty fare ticket at a price ten times higher than the value of a single trip ticket. The ticket shall be punched by the ticket inspector. This entitles the passenger to continue his/her travel in the same vehicle.

(5) For every piece of luggage subject to a charge that has not been paid, the passenger has to purchase a penalty fare ticket at a price ten times higher than the value of a single trip ticket. The ticket shall be punched by the ticket inspector. This entitles the passenger to continue his/her travel in the same vehicle.

Art. 36 (1) (Amended by Resolution No 433 as per Minutes 43 from 25.06.2009) If a passenger refuses to pay the penalty fare for travelling without a valid transport document or purchase a ticket for a passenger with a non-validated smartcard, the ticket inspector shall issue a statement of administrative offence in line with the Administrative Violations and Sanctions Act to the passenger for either of these offences whereby the conductor shall compel the passenger to disembark at the first stop on the route of the vehicle. The invalid paper transport document is taken from the passenger and is handed over to the responsible departments of Urban Mobility Centre EOOD and Metropoliten EAD. An invalid transport document in electronic form shall be blocked until the fine is paid.

(2) (Amended by Resolution No 433 as per Minutes 43 from 25.06.2009) If found to be travelling with a falsified or blocked transport document, the passenger shall be compelled to get off the vehicle and a statement of administrative offence shall be drawn up by the conductor in line with the Administrative Violations and Sanctions Act. The falsified or blocked transport document is taken from the passenger and is handed over to the responsible departments of Urban Mobility Centre EOOD and Metropoliten EAD.

(3) The officials (conductors), appointed by the Manager of Urban Mobility Centre EOOD and the Executive Director of Metropoliten EAD, shall draw up statements of offences to the persons in violation upon each ascertained offence in accordance with the powers granted to them herein.

(4) On the basis of the drawn up statements of administrative offences pursuant to Аrt. 36 (1) and (2) as related to Аrt. 35 (2), (3), (4) and (5) from this Ordinance, the Mayor of Sofia or his/her authorized deputy shall issue penal orders.

(5) Institution of proceedings, drawing up of statements of administrative offences, issuance, summons service and appeals against the penal orders as well as determination of the fine is done in accordance with the Administrative Violations and Sanctions Act.

(6) The fines provided for in the event of penal orders are as follows:

1 For offences stated in Art. 36(1) as related to Art. 35(2), (4) and (5) of this Ordinance – BGN 70.00.

2 For offences stated in Art. 36(2) of this Ordinance – BGN 100.00.

3 For offences stated in Art. 36(1) as related to Art. 35(3) of this Ordinance – BGN 10.00.

Art. 37 (1) Minors over 16 years of age shall also be held liable for administrative offences if they are found to be competent enough to understand the nature and the significance of the offence and the consequences of their actions.

(2) (Amended by Resolution No 433 as per Minutes 43 from 25.06.2009) Liability for violations committed by minors between 14 and 16 years of age, who have been placed under interdiction, shall be borne by their parents, custodians or guardians if they knowingly allowed the violation to happen or were in a position to prevent it but they did not. A statement of findings shall be drawn up in such an event, based on which one of the parents, custodians or guardians shall be issued with a statement of administrative violation in line with the Administrative Violations and Sanctions Act.

Art. 38 The Manager of Urban Mobility Centre EOOD and the Executive Director of Metropoliten EAD shall have the right to hire under a contract sergeant police officers from Sofia’s Head Police Department to control and protect public order during inspections of the validity of passengers’ transport documents in the vehicles.

Art. 39 (1) In the event of any non-observance of the rules of order in the vehicles, stipulated in this Ordinance, the infringer must pay a penalty fare to the conductor of a price ten times higher than the cost of the single trip ticket. Such a ticket has to be punched by the conductor.

(2) If any damages of the public transport vehicles and facilities are found by the conductors of the operators, a statement of findings must be drawn up for the purposes of Urban Mobility Centre EOOD, Metropoliten EAD, Sofia Municipality, the Ministry of Interior and the Ministry of Transport and Communications. The statement of findings shall contain the following data: details of the perpetrator of the damage, kind of the damage, place, date and time it was caused. The statement shall be signed by the conductor and the perpetrator of the damage.

(3) If the perpetrator refuses to sign the statement of findings, the document shall be certified by the signature of the ticket inspector and one witness.

(4) Unless the perpetrator freely agrees to cover the cost of the damage, the cost shall be recovered through court action.

Art. 40. Officials from the Transport Department at the Municipality of Sofia, Sofia Urban Mobility Centre EOOD and the municipal transport companies (Appendix No 4) shall perform inspections in the vehicles and MPT facilities as part of their official duties. They shall identify themselves by their personal official pass.

VIII. PENAL PROVISIONS

Art. 41. Officials who submit false information to enable the issue of concession travel cards documents shall face disciplinary action, if they are not liable to other punitive actions in accordance with the Criminal Code.

Art. 42 If officials, who are authorized to issue concession cards, do not observe the regulations herein, they shall face disciplinary proceedings as per the provisions of the Labour Code and, if there are grounds therefor, criminal proceedings as per the provisions of the Criminal Code.

Art. 43 (1) Transport documents for concession travel by MPT are personal. Persons who let others use their concession cards forfeit their right to concession travel until the end of the calendar year and the transport document is confiscated.

(2) In the event that a passenger is found in the possession of a duplicate travel (smart)card for a person entitled to concession travel, the duplicate shall be confiscated, with the holder of the invalid card issued a statement of administrative offence. The holder of the original card forfeits the right to concession travel by MPT until the end of the calendar year.

IX. OBJECTIONS, DUPLICATES AND FEES

Art. 44 At the time of purchase, the buyer of a transport document has the right to object to incorrect data being entered into the document or to being given incorrect change.

Art. 45 (1) The value of a partially or completely unused transport document for concession travel may be refunded in the following cases:

1.Change of address of residence or place of work (place of study) of the cardholder;

2. If the cardholder suffers a bout of illness for 10 consecutive days;

3.Death of the cardholder;

4.Change of the route of the service for more than 5 working days or its complete closure;

(2) The claim for refund of the amount of a partially or completely unused transport document in the cases stipulated in Par. 1, Item 1, 2 and 3 must be supported by an appropriate document, proving the grounds for the claim (as per Item 3 and a certificate of inheritance). The transport document must also be attached thereto.

(3) The refundable amount from a transport document shall be calculated from the certified date of receipt of the claim for refund to the expiry of the validity period. Ten percent of the refundable amount shall be withheld, with the exception of the cases stated under Par. 1, Items 3 and 4;

(4) In the cases under Par. 1, Item 2 the transport document must be deposited at the office where it was issued first.

Art. 45a (New By Resolution No 433 as per Minutes No 43 from 25.06.2009) The value of a partially or completely unused paper or smartcard transport document for one or two lines at the standard rate can be refunded in case of change in the route of the line(s) for more than 5 working days or complete closure of the line(s). The refundable amount from an unused transport document shall be calculated from the date of submittal of the refund claim until the expiry of the term of validity for which the card was issued/credited.

Art. 46 (1) In the event of change of the route or other reasonable grounds, a transport document that has been issued/credited for one line can be transferred to another line for the same term of validity. The transfer shall be carried out in the relevant department of the issuer.

(2) When a transfer is requested without providing reasonable grounds such as change in the route for which the card was issued/credited, the person shall pay BGN 5.00 for the service.

Art. 46(a) (New by Resolution No 433 as per Minutes No 43 from 25.06.2009) An anonymous travel smartcard issued in line with the provisions of Art. 17, Par. 1 and a concession travel smartcard may be blocked by request of the holder after the same fills in a standard application to request blocking of the smart card and presents a personal identification document or a certificate from the District Police Department. In case of theft or damage, the smartcard for disabled persons who are entitled to use an assistant may also be blocked by either of the assistants after a standard application to request blocking of the smart card has been filled in and a personal identification document or a certificate of the assistant or the holder from the Regional Police Department has been presented.

Art. 47 (1) (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) A duplicate of a paper transport document shall not be issued except in the event of damage that has left the term of validity of the document legible/readable by card-reader, with the cost of the service being BGN 5.00.

(2) (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) A duplicate of a paper concession travel card for the relevant validity period shall be issued one and only time within 10 days from submission of the claim, with the cost of the service being BGN 5.00.

(3) (New by Resolution No 433 as per Minutes No 43 from 25.06.2009) A duplicate of an anonymous travel card, issued in line with Art. 17, Par. 1 and a concession travel smartcard shall be issued after the original has been blocked. The period, credited to the blocked card, shall be transferred to a new smartcard within 3 days from the date of submission of a Request for Blocking of Smartcard. The service costs BGN 5.00 plus a charge for the smartcard as per Appendix No 2 of the Ordinance. A new smartcard shall not be issued to a person whose card has been blocked in accordance with Art. 36, Par. 1 until payment of the fine.

(4) A duplicate of a concession card for disabled persons who are entitled to use an assistant shall be issued only to the disabled persons and not to the assistants.

(5) When a duplicate of an invoice for the current month is issued, the person must pay BGN 2.00 for the service within five working days from submitting the claim.

X. INSURANCE

Art. 48 A passenger with a valid transport document is insured under an Accident Insurance Policy for Passengers on MPT.

Art. 49. If an insured event occurs, the passenger must inform the operator or the operator’s contracted insurance company.

XI. FINAL PROVISIONS

§ 1. (1) This Ordinance shall be amended by resolutions of the Sofia Municipality Council.

(2) The prices of passenger transport are listed in an Appendix to the Ordinance and shall be amended according to the Rules on Pricing of Transport Documents for Mass Transit on the Territory of the Municipality of Sofia after approval of the Sofia Municipality Council.

(3) A person who purchases/credits concession cards for school-goers and/or university students of value over BGN 390.00 shall be issued a one-month anonymous travel card for all lines with a 50% discount in accordance with the regulations of the Ordinance.

(4) (Amended by Resolution No 433 as per Minutes No 43 from 25.06.2009) The following discounts shall be made when the issuance/topping up of anonymous travel cards for companies or state departments is paid via bank transfer:

- more than 50 paper or electronic travel cards – 2% of the total amount

- more than 150 paper or electronic travel cards – 3% of the total amount

- more than 1000 paper or electronic travel cards – 10% of the total amount

§ 2 This ordinance hereby revokes the Ordinance on Passenger Transit and the Conditions of Travel in Mass Public Transport on the Territory of the Municipality of Sofia, duly accepted by Resolution No 36 from 14.03.2000 as per Minutes No 8 from 14.03.2000.

§ 3 (New by Resolution No 433 as per Minutes No 43 from 25.06.2009) Throughout the Ordinance the words “Sofia Public Transport Company EOOD” shall be replaced with “Sofia Urban Mobility Centre EOOD”.

§ 4 This Ordinance was adopted by Resolution No 458 from 24.07. 2008 of the Sofia Municipality Council as per Minutes No 17 from 24.07.2008, and becomes effective on 01.09.2008.
